Terms of Service

Welcome to Walky Doggy! These Terms of Service ("Terms") govern your use of the Walky Doggy mobile application ("App", "Service", "we", "us", or "our"). By downloading, installing, or using Walky Doggy, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Walky Doggy, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of significant changes via in-app notification or email. Continued use after changes constitutes acceptance of the updated Terms.

2. Eligibility

• You must be at least 13 years old to use Walky Doggy
• If you are under 18, you must have parental or guardian consent
• You must provide accurate and complete registration information
• You are responsible for maintaining the confidentiality of your account credentials
• You may not use Walky Doggy for any illegal or unauthorized purpose

3. Account Responsibilities

3.1 Account Security

• You are solely responsible for all activities under your account
• Notify us immediately at support@walkydoggy.fr if you suspect unauthorized access
• Do not share your password or allow others to access your account
• Use a strong, unique password

3.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activities
• Harass or harm other users
• Post inappropriate or offensive content
• Attempt to manipulate the token system or challenges

4. User Content

4.1 Your Content

You retain ownership of content you post (photos, comments, dog profiles, walk data). By posting content, you grant Walky Doggy a non-exclusive, worldwide, royalty-free license to:

• Display, store, and distribute your content within the App
• Use content for marketing and promotional purposes (with your consent)
• Backup and cache content for service reliability

4.2 Content Guidelines

You agree NOT to post content that:

• Is illegal, harmful, threatening, abusive, or discriminatory
• Infringes intellectual property rights of others
• Contains personal information of others without consent
• Is sexually explicit, violent, or graphic
• Contains spam, advertising, or malicious code
• Impersonates another person or entity
• Is misleading or fraudulent

4.3 Content Moderation

• We reserve the right to remove content that violates these Terms
• User reports help us identify problematic content
• We are not responsible for user-generated content
• Content removal does not require prior notice

5. Location Services and GPS

• Walk Tracking: Walky Doggy uses GPS to track walk routes, distance, and duration
• Permission Required: Location access must be granted for walk tracking to function
• Accuracy: GPS accuracy depends on device hardware, signal strength, and environmental factors
• Battery Usage: Continuous GPS usage during walks may drain battery faster
• Privacy: Location data is only collected during active walks and is not shared without your consent

6. Subscriptions and Payments

6.1 Premium Subscription

• Plans: Monthly, Yearly, and Lifetime subscriptions available
• Features: Ad-free experience, 2x token multiplier, unlimited photos, premium badge
• Pricing: Displayed in the app at the time of purchase (subject to change)
• Payment: Processed through Apple In-App Purchase

6.2 Auto-Renewal

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged within 24 hours prior to renewal
• Manage subscriptions in iOS Settings → [Your Name] → Subscriptions
• No refunds for partial periods if you cancel mid-cycle

6.3 Free Trials

• Free trial periods may be offered for new subscribers
• You must cancel before the trial ends to avoid charges
• One free trial per user (Apple ID)
• Canceling during trial maintains access until trial end date

6.4 Refunds

• All purchases are final and non-refundable except as required by law
• Refund requests must be submitted to Apple directly (not Walky Doggy)
• We reserve the right to issue refunds at our discretion

7. Virtual Currency (Tokens)

7.1 Token System

• Tokens are virtual currency earned through walks, challenges, and achievements
• Tokens can be spent in the Token Shop for virtual items
• Tokens have no real-world monetary value and cannot be exchanged for cash
• Premium users earn 2x tokens compared to free users

7.2 Token Policy

• We reserve the right to adjust token earning rates and shop prices
• Tokens may expire or be reset in case of account violations
• Attempting to manipulate the token system may result in account termination
• Tokens are non-transferable between users

8. Third-Party Integrations

8.1 Strava Integration

• Connecting Strava is optional
• Strava data import requires explicit authorization
• You can disconnect Strava at any time
• Strava's Terms of Service apply to integrated data

8.2 Advertising (Free Users)

• Free users will see ads via Google AdMob
• Ads are personalized based on Google's advertising policies
• You can opt out of personalized ads in iOS Privacy Settings
• Premium users enjoy an ad-free experience

9. Intellectual Property

9.1 Our Rights

• Walky Doggy, logo, design, and content are owned by us and protected by copyright, trademark, and other laws
• You may not copy, modify, distribute, or reverse-engineer the App
• You may not use our trademarks without written permission

9.2 Your Rights

• We grant you a limited, non-exclusive, non-transferable license to use Walky Doggy for personal, non-commercial purposes
• This license automatically terminates if you violate these Terms

9.3 Copyright Infringement

If you believe content in Walky Doggy infringes your copyright, contact us at support@walkydoggy.fr with:

• Description of the copyrighted work
• Location of infringing content in the App
• Your contact information
• Statement of good faith belief
• Statement that information is accurate and you're authorized to act

10. Disclaimers and Limitations

10.1 "As Is" Service

Walky Doggy is provided "AS IS" without warranties of any kind, express or implied, including but not limited to:

• Fitness for a particular purpose
• Merchantability
• Non-infringement
• Accuracy, reliability, or availability

10.2 Limitation of Liability

10.3 GPS Accuracy Disclaimer

GPS tracking may be inaccurate due to signal interference, device limitations, or environmental factors. We do not guarantee accuracy of distance, speed, or route data.

11. Indemnification

You agree to indemnify, defend, and hold harmless Walky Doggy, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post or share

12. Privacy and Data Collection

Our Privacy Policy explains how we collect, use, and protect your data. By using Walky Doggy, you consent to data collection as described in the Privacy Policy.

• We collect location data during walks
• We use Firebase for hosting and analytics
• We show ads via Google AdMob (free users)
• We integrate with Strava if you authorize it

13. Governing Law and Disputes

13.1 Jurisdiction

These Terms are governed by the laws of France, without regard to conflict of law principles.

13.2 Dispute Resolution

• Informal Resolution: Contact us at support@walkydoggy.fr to resolve disputes informally
• Arbitration: Disputes not resolved informally shall be resolved through binding arbitration
• Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

14. Termination

14.1 By You

• You may delete your account at any time via Settings or by contacting support
• Upon deletion, your data will be removed within 30 days
• Active subscriptions remain active until the end of the billing period

14.2 By Us

• We may suspend or terminate your account for violations of these Terms
• We may discontinue Walky Doggy at any time with 30 days' notice
• Termination does not entitle you to refunds

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Walky Doggy regarding use of the App.

18. Apple Terms

As Walky Doggy is distributed via the Apple App Store, you must also comply with Apple's Licensed Application End User License Agreement (LAEULA).

• Apple has no warranty obligations
• Apple is not responsible for addressing claims related to the App
• Apple is a third-party beneficiary of these Terms
